PLEASE READ THESE TERMS OF SERVICE CAREFULLY. BY ACCESSING, REGISTERING FOR, OR USING THE FREEPDF WEBSITE AND SERVICES, YOU AGREE TO BE BOUND BY THESE TERMS AND ALL TERMS INCORPORATED BY REFERENCE. IF YOU DO NOT AGREE TO ALL OF THESE TERMS, DO NOT ACCESS OR USE THE SERVICES.

1. Acceptance of Terms

These Terms of Service (“Terms”) constitute a legally binding agreement entered into between you, whether personally or on behalf of an entity (“User”, “you”, “your”), and Fikirizma Media (“Company”, “we”, “us”, or “our”), concerning your access to and use of the www.freepdf.co website, its APIs, document processing tools, and all related infrastructure (collectively, the “Service”).

By using the Service, you represent and warrant that you have read, understood, and agree to be bound by these Terms, along with our Privacy Policy, Acceptable Use Policy, and Refund Policy.

2. Eligibility and Account Registration

2.1. Age Requirement: The Service is intended for users who are at least 16 years of age (or the age of digital majority in your jurisdiction). By using the Service, you represent and warrant that you meet this age requirement.

2.2. Account Security: To access certain features (e.g., Pro subscriptions), you may be required to register for an account. You agree to provide true, accurate, current, and complete information. You are strictly responsible for maintaining the confidentiality of your account credentials (passwords, OAuth tokens). You must immediately notify us of any unauthorized use of your account. We are not liable for any loss or damage arising from your failure to safeguard your account.

3. Nature of the Service & Limited License

3.1. License Grant: Subject to your strict compliance with these Terms and payment of any applicable subscription fees, the Company grants you a limited, non-exclusive, non-transferable, non-sublicensable, and revocable license to access and use the Service for your personal or internal business purposes.

3.2. Temporary Processing: FreePDF is a technical document manipulation tool (converting, merging, editing, etc.), NOT a cloud storage or backup service. All files uploaded to our servers are permanently and irrevocably deleted within 24 hours of upload. We hold no responsibility for storing or maintaining your documents.

4. Document Validity & E-Signature Disclaimer (Critical)

4.1. Legal and Technical Integrity: The Service modifies the binary and metadata structures of digital files. You explicitly acknowledge and agree that processing a document through FreePDF may alter its original formatting, remove metadata, or invalidate cryptographic digital signatures (e-signatures), watermarks, and legal stamps.

4.2. User Responsibility: We do not guarantee the legal validity, admissibility, or technical integrity of any output generated by the Service. You are solely responsible for reviewing and verifying the accuracy and legal standing of any processed document before utilizing it for official, legal, corporate, or government purposes.

5. Prohibited Conduct and Acceptable Use

As a condition of your use of the Service, you agree NOT to engage in any of the following prohibited activities:

5.1. System Abuse & Bypassing Limits:

• Using Virtual Private Networks (VPNs), proxy servers, TOR, rotating IP addresses, disposable email addresses, or browser fingerprint spoofing to bypass our daily free-tier limits or access restrictions.
• Using automated scripts, bots, scrapers, spiders, or undocumented API calls to mass-process files or extract data from the Service.

5.2. Illegal and Malicious Content:

• Uploading documents containing malware, viruses, trojan horses, ransomware, or malicious macros designed to interrupt, destroy, or limit the functionality of our infrastructure.
• Uploading Child Sexual Abuse Material (CSAM). Any detection of CSAM will result in immediate preservation of your access logs and reporting to international law enforcement (e.g., NCMEC, Interpol).
• Uploading, processing, or forging counterfeit documents, fake government IDs, passports, bank statements, or any materials designed to facilitate financial, identity, or academic fraud.

5.3. Reverse Engineering:

• Decompiling, reverse engineering, disassembling, or otherwise attempting to derive the source code, trade secrets, or algorithms of the Service.

6. Fair Use Policy for “Unlimited” Subscriptions

Our “Pro” subscription tiers may offer “unlimited” file processing. However, this is strictly governed by a Fair Use Policy intended to ensure server stability for all users. “Unlimited” is defined as normal, manual, human-driven usage. You may not utilize your Pro account to run automated workflows, API scrapers, or enterprise-scale bulk processing (e.g., attempting to process thousands of files per hour). We reserve the right to throttle, suspend, or terminate Pro accounts that exhibit non-human, abusive usage patterns without refund.

7. Billing, Subscriptions, and Merchant of Record

7.1. Paddle as Merchant of Record: Our order process, payment collection, invoicing, and tax compliance (VAT/GST) are conducted by our authorized online reseller and Merchant of Record, Paddle.com. By purchasing a Pro subscription, you also agree to Paddle’s Terms and Conditions.

7.2. Renewals and Cancellations: Paid subscriptions automatically renew at the end of their respective billing cycles (Weekly, Monthly, Yearly). You must cancel your subscription at least 48 hours prior to the renewal date to avoid the next charge.

7.3. Refunds: Due to the immediate access to digital content, users generally lose their right of withdrawal once processing or downloading begins. Please review our comprehensive Refund Policy for specific terms, exceptions, and Paddle’s sole discretion regarding refunds.

8. Intellectual Property Rights

8.1. Your Content: You retain all copyright, trademarks, and ownership rights to the files you upload (“User Content”). You grant us a temporary, automated, and limited license to host and process your User Content strictly for the purpose of providing the Service to you. We claim no ownership over your files.

8.2. Company Property: The Service, including its UI, UX, source code, algorithms, brand names, logos, and domain names (FreePDF), are the exclusive intellectual property of Fikirizma Media. You are prohibited from copying, distributing, or creating derivative works of our software or branding without explicit written consent.

9. Disclaimer of Warranties

THE SERVICE IS PROVIDED ON AN “AS-IS” AND “AS-AVAILABLE” BASIS. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, FIKIRIZMA MEDIA EXPRESSLY DISCLAIMS ALL WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING, BUT NOT LIMITED TO, THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.

WE DO NOT WARRANT THAT: (A) THE SERVICE WILL MEET YOUR REQUIREMENTS OR EXPECTATIONS; (B) THE SERVICE WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE; (C) THE RESULTS OR OUTPUTS GENERATED BY THE SERVICE WILL BE ACCURATE, RELIABLE, OR RETAIN LEGAL VALIDITY; OR (D) ANY ERRORS IN THE SOFTWARE OR INFRASTRUCTURE WILL BE CORRECTED. ANY MATERIAL UPLOADED OR DOWNLOADED IS DONE AT YOUR OWN DISCRETION AND RISK, AND YOU WILL BE SOLELY RESPONSIBLE FOR ANY DAMAGE TO YOUR COMPUTER SYSTEM OR LOSS OF DATA.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL FIKIRIZMA MEDIA, ITS FOUNDERS, DIRECTORS, EMPLOYEES, AFFILIATES, OR AGENTS BE LIABLE TO YOU OR ANY THIRD PARTY FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO DAMAGES FOR LOSS OF PROFITS, REVENUE, GOODWILL, USE, DATA, DOCUMENT CORRUPTION, BUSINESS INTERRUPTION, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF, OR INABILITY TO USE, THE SERVICE.

NOTWITHSTANDING ANYTHING TO THE CONTRARY CONTAINED HEREIN, OUR TOTAL, CUMULATIVE LIABILITY TO YOU FOR ANY AND ALL CLAIMS ARISING FROM OR RELATING TO THESE TERMS OR YOUR USE OF THE SERVICE, REGARDLESS OF THE FORM OF ACTION (CONTRACT, TORT, NEGLIGENCE, STRICT LIABILITY, OR OTHERWISE), SHALL AT ALL TIMES BE STRICTLY LIMITED TO THE GREATER OF: (A) FIFTY US DOLLARS ($50.00 USD), OR (B) THE TOTAL AMOUNT YOU PAID TO PADDLE FOR THE SERVICE DURING THE THREE (3) MONTH PERIOD IMMEDIATELY PRECEDING THE EVENT GIVING RISE TO THE LIABILITY.

11. Indemnification

You agree to indemnify, defend, and hold harmless Fikirizma Media, its affiliates, officers, directors, employees, and agents from any and all third-party claims, liability, damages, losses, and costs (including, but not limited to, reasonable attorneys’ fees) arising from:

• Your access to or use of the Service;
• Your breach or alleged breach of these Terms;
• Your infringement of any intellectual property or other right of any person or entity;
• Any legal, financial, or regulatory consequences resulting from a forged, illegal, or corrupted document you processed using the Service.

12. Dispute Resolution and Class Action Waiver

12.1. Governing Law: Excluding payment and billing disputes (which are governed by Paddle’s terms and the laws applicable to Paddle), these Terms and your use of the Service shall be governed by and construed in accordance with the laws of the Republic of Türkiye, without giving effect to any principles of conflicts of law.

12.2. Venue: Any legal action or proceeding related to the Service shall be brought exclusively in the state or federal courts located in Antalya, Türkiye, and you consent to the exclusive jurisdiction and venue of such courts.

12.3. Class Action Waiver: YOU AND FIKIRIZMA MEDIA AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS, CONSOLIDATED, OR REPRESENTATIVE PROCEEDING.

13. Termination

We may terminate or suspend your account and bar access to the Service immediately, without prior notice or liability, under our sole discretion, for any reason whatsoever and without limitation, including but not limited to a breach of these Terms. If you wish to terminate your account, you may simply discontinue using the Service. All provisions of the Terms which by their nature should survive termination shall survive termination, including, without limitation, ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

14. Changes to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will provide at least 15 days’ notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion. By continuing to access or use our Service after any revisions become effective, you agree to be bound by the revised terms.
